THQ issued NASDAQ delisting notice

Publisher's stock price must hit $1 or above for 10 consecutive days before July 23 or it will be subject to removal from global market.

Troubles for publisher THQ are continuing to pour in. Today, the company said it has received written word from the NASDAQ global stock market noting that if the California-based publisher's per-share price does not post gains, it will face removal from the exchange.

Because THQ's stock price has been valued at below $1 (the minimum requirement for continued listing) for 30 consecutive days, its future on the market is in question. A single share of THQ stock is valued at $.70 as of press time. A year ago this week, THQ stock was trading for over $6 per share.

However, THQ has time to right its ship. If the publisher's stock value closes at $1 per share or above for 10 consecutive days before July 23, 2012, THQ will remain listed on NASDAQ.

If THQ's stock price does not rise within the allotted time, the publisher still has some options to keep its company listed on NASDAQ. THQ can appeal the decision and stand before a hearings panel to decide its fate. The company can also transfer its capital to the NASDAQ Capital Market, where it will be granted another 180 days to reach compliance.

THQ isn't the first game publisher to face delisting pressure from NASDAQ. Atari and Majesco were each served delisting warning notices twice.

THQ has been undergoing significant restructuring as of late. Last week, the publisher announced it was exiting the children's game segment, instead streamlining its business and focusing principally on its core franchises.

Additionally, the company has cut staff at its Australian outfit, as well as at its Agoura Hills, California, headquarters. THQ will provide further information concerning its new direction during its third-quarter 2012 financial call on February 2.

@warhawk-geeby Very good point. Thanks. I was referring to ongoing server costs for online play and free downloadables. Particularly as games get older, new sales dwindle and yet new players are still joining. Two players using the same copy are not accessing those servers at the same time, but it's still a 2-person share when you consider ongoing costs to the provider. Example: Bob plays Game online for 6 months. Trades his copy in. Joe buys it used, and plays online for 6 months (or at least, thinks he's entitled to). @Lhomity Just a quick point to you, and then one for the crack-head. "...people like you make that decision on games everyday, then expect the developers to provide you with stable online servers you didn't pay for, free patches and DLC you aren't supporting them for." I understand all of your other comments, in fact I couldn't agree more. But this one is flawed. If the game has been purchased in the first place than someone has paid the initial debt to allow online server access for that copy of the disc, and for any bugs or glitches to be fixed - the duties have been paid regardless of the owner. It's not as if there's now two people playing the game, it's still only the one. Games have advanced a long way in the last decade and the market is huge, but the price of games have also gone up to deal with it. So much is covering the costs, but I think some of it greed as Legrieme said. However.. @Legrieme Did South Park not teach you anything about drugs..? :|

Well im telling the truth that darksiders poor game and thq to blame reasleing poor games , darksiders like ps2 port game but god of war 3 was better than darksiders and realseing number 2 will make things worst. For Merto 1 it didnt sell on its on for xbox thats why they bringing Mertro 2 wont sell even on pc and ps3. WWE need to change the whole series, Saints row 4 if there is going to be 4 need to change again. THQ need to change who they are because homefront was hardcore game and tebblie gameplay and grapihics. Because THQ didnt work great on it and yes its thq fault for makeing games what doent work out. THQ try pass codes well thats wasnt the problem was it . I think for homefront 2 i think cyteck should buy homefront series off. Midway been down this path before and they face bankrupht and had sell off there games. Saint Row 2 sold but for actively missions put pp off since thq didnt care about story . thq manger no gd because they dont visit the buliding what pp working on.

@Lhomity you mention people buying used games in order to save $5 which just isn't true in most cases. Most people aren't that cheap and would rather have the game new then get a few bucks off. People mostly buy used when there is a huge gap between the new and used price or if they can get a game cheap from a friend, ebay, ect. When a game is 35 used and 60 new then buying used makes much more sense. I disagree with many of your views but don't really have the space to refute here.

copying off other games with your own IP will always make you go bust if you spend millions on the project. With Homefront they had an opportunity to do something thats not Call Of Duty or Battlefield. Yet chose to just be like them. They didnt ask the super question. Why should the player play this over Call Of Duty and Battlefield? There was no answer, so we gamers didnt bother. However they have published awesome games in the past Smackdown 1 and 2 on PS1 Company of Heroes on PC (sold millions of copies) STALKER (4 million sold) Dawn Of War (millions sold) Surpreme commander Broken Sword 1 and 2(still one of the best adventure games EVER made) Moto Gp 3 on PC and Moto Gp 07 Red faction 1 and 2 Summoner WCW NITRO etc So they have done some awesome games, just not enough AAA titles. Theres only a handfull of games that make TONS of money on console. If you just copy whoever has made the most moneyyeseterday, youll never seperate yourself from the pack to make the cash.

@Legrieme (Continued) And no, the used car argument is misguided. Without online passes, when you buy a used game, you're essentially getting the same thing you would get in a new copy. Sure, a manual might be absent in some cases, the disc may even have a finger mark or two, but that's another issue and you get what you pay for. When you buy ANYTHING AT ALL used, there's an acceptance that it is not going to be as adequate as a new item. A used car does not come with perks and frills like free registration and manufacturer warranty. Then there's mileage, and of course the brakes and others parts aren't going to be factory issue. You wouldn't buy a used car and expect it to be just as good as a new car, would you? You're probably buying a used car because you can't afford new, and it will likely get you around well enough - but not being able to afford a brand new DB9 does not entitle you to the same performance. Also, nobody buys used cars from the same year. Nobody makes decisions like "." But people like you make that decision on games everyday, then expect the developers to provide you with stable online servers you didn't pay for, free patches and DLC you aren't supporting them for. Again, who is greedier here? Those drugs you mentioned are clearly affecting your judgment.

@Legrieme I assure you I do not own shares in any company, nor am I an employee of any developer or publisher. Nickel-and-diming, huh? On your side of the fence, it may appear that the evil tyrannical game developer is trying to squeeze a few more dollars out of you, but in the real world, they are working people in one of the most competitive entertainment industries in the world. People with children to feed, bills to pay, and several million hormonal teenagers moaning at them on the internet. In the past, the used game market wasn't a major concern. It provided a means for consumers to access old games no longer in print - and in years to come it may continue to do that unless we continue to abuse it. Now, the used-game market has become over-blown, and a far greater number of gamers are choosing to save a few dollars by purchasing used. After all, what incentive is there to buy new when you get to the counter at Gamestop, new game in hand, and the acne-ridden preppie behind the counter reminds you there's an identical used copy. Its easy to throw around terms like "" at a company that wants money for the content they create for you to enjoy. An online pass merely provides incentive for gamers to buy new, by excluding a small portion of trivial content. Joe Gamer doesn't care so long as he saves a few measly dollars, but still feels like he has some entitlement to 100% content, and feels violated because he can't play as Catwoman. Who is greedier?

@Legrieme I'm sorry but I think Lhomity is making valid statements. A new game has cost £40 for for many years, certainly back to PS1 days if not before, and the cost of game development has seen a huge increase. I'm also sure I read somewhere once that some of the £40 has to go to MS or Sony, but I could be wrong there. And your DVD argument is terrible. The film industry aims to make the vast majority of its money at the box office. The biggest problem is the quality of games. £40 for an ok 8 - 10 hour game isn't a good deal and alot of people will buy a cheap second hand copy because they don't see it as value for money. But back to THQ........they really need to sort out the WWE games - that licence can't be cheap!

@Lhomity Either you own stock (and by stock I mean a whopping 10 shares) in a game company, or you are really REALLY not understanding anything. You continuously defend companies who nickel and dime consumers and state that it is a GOOD THING to have an Online Pass (or in Batman's case, stripped-out single-player content) in a game. Never in the past 30+ years of gaming has Used Games EVER been talking about by Developers/Publishers as such a huge problem as it has in the past couple of years. Why is that? Greed. I don't know what happened to the world in the past few years, but in EVERY ASPECT of the world, companies have gotten greedier and greedier. The car comparison is not only valid, it is the exact same thing. Another great and identical example would be Used DVD's, or for that matter, ANYTHING YOU CAN POSSIBLY BUY AND RESELL USED. It's quite obvious own stock in THQ and/or you're a blind patriot of Developers without knowing any facts behind it. It's futile to try and debate the facts with you anymore so I won't bother. I'm going to go take some drugs, smoke some cigarettes and pass out again. When I wake up, I hope you'll be smarter.

I always hate to see the troubles THQ is getting into lately; they're my favorite publisher, and maybe the only big, but at the same time humble, game publisher. And they aren't greedy, they're just trying to make money. And they work hard for it, so they well deserve it.

I think creators of sanits row series need to be buy out from squearenix because they did great with just caurse game.This is going to be bad ending for thq if they dont sort it out. @Legrieme Normally, I wouldn't respond to someone who resorts to name-calling, but I feel sympathetic in this case, because I believe you are misguided. The used game market has a valuable place in preserving the legacy of old games, but it exists as a detriment to sales of new games. Devs get nothing when you choose to buy used instead of new. When we're talking about an old game you probably can't buy new anymore, its not a major issue. And if the game requires an online pass, it can be purchased for a mere $10 (Quite generous, don't you agree?) Now you might say: ", is merely devs trying to protect their income by giving you a reason to buy new. The car argument is a common one. Alas, a misguided one. Games are not cars, and a used car does not come with many of the frills included in a new car (free stamp duty and rego, manufacturer warranty, etc). An online pass is a frill for new game owners. Think about it.

The core of the "gaming community" that buy new and support the industry haven't a problem with online passes. That only bothers the gamers who don't mind lining Gamestop's pockets to save $5 on a used copy and then moan about having to buy a pass. Because, you know, ensuring the creative people behind the games you play get a portion of the money owed to them is pretty messed up. Gosh, devs are greedy.

I haven't an appetite for destruction, but I almost want to see a publisher the size of THQ fall, and serve as a shining reminder of how the used game market and piracy is affecting the industry. A martyr, of sorts. The sad fact is, an overwhelming number of gamers are ignorant and won't pay attention anyway. Sure, they'll comment about how sad it is to see more publishers and devs close, but every time they hear the word " I'm not going to write a eulogy for THQ just yet, but I'll prepare some notes because their turkey is looking very well done.

I have some advice for THQ. Fix the WWE series. It has been complete garbage for a decade. Take WWF No Mercy and all that made it the best Wrestling game ever and just give it a current gen face lift. Take that exact gameplay system, the same move sets, that depth in customization, that depth in content creation and don't change anything. Only improve visually and expand options on all fronts. Do this and you will sell 10 million of these games. Or keep making uninspired, shallow garbage with a potentially valuable license. I hope THQ right the ship because I thought SR3 was amazing and I loved Darksiders and will be getting Darksiders 2.

Hey, the lot of you worrying about your oh-so-favorite franchises! I wouldn't be worried about them though (if I am actually bothered to worry about them), . If and when THQ goes under, expect the administrators to sell these (or rather their licensing rights) away to very eager buyers (assuming that these can work out new deals with the licensors). For the not-so-profitable ones, like Dawn of War, well... there won't be many buyers, if any at all. On the other hand, if they are license-based products (like Dawn of War, which is produced using a license from Games Workshop, and Metro) you can always wait for the licenses to lapse, and the licensors can shell out licenses to interested game-makers other than THQ! But for fully proprietary franchises like Company of Heroes, which wasn't exactly a commercial success? Expect them to die.

This is what happens when you invest in garbage ventures instead of being content with loyal fans. It's a shame, but the fact is that it wasn't bad luck for THQ; they did in fact bring it on themselves. Hope they can dig themselves out of this mess, though I don't see how.
